Terms and Conditions

All travel participants will be provided a full version of the Maritz Journeys Terms and Conditions after they have reserved their travel arrangements.  The following information is excerpted from the full compliment of the terms and conditions provided to all confirmed travelers by Maritz Journeys which they will be required to endorse and return. 

Responsibility: The traveler acknowledges that Maritz Journeys, its parent, subsidiary and affiliated companies maintain no control over the independent suppliers that will be providing accommodations and services as a part of the travel program. Accordingly, the undersigned agrees not to hold Maritz Journeys or their respective parent, subsidiary or affiliated companies responsible for any loss or injury which may be caused or contributed to by such suppliers or by any other cause, condition or event whatsoever beyond the direct control of Maritz Journeys or their respective parent, subsidiary or affiliated companies. The undersigned hereby release Maritz Journeys, its parent, subsidiary and affiliated companies, and their respective officers, directors, employees and agents from any and all liability for claims resulting from any acts or omissions of the independent travel suppliers providing accommodations and services in connection with the travel arrangements, or from any other cause, condition or event beyond the direct control of Maritz Journeys or its parent, subsidiary or affiliated companies.

Payment & Cancellation: In the event that the traveler must cancel their trip, they understand that the non-refundable planning fee is above and beyond the penalties accrued by the cruise lines, tour operators, hotels, airlines or other service providers. The specific payment and cancellation terms for the trip purchased have been provided to the traveler either verbally or in writing by the Maritz Journeys Destination Specialist. Airline ticket costs are not guaranteed and are subject to change prior to ticketing.  If the traveler elects to change the destination for services and an invoice has been provided, Maritz Journeys reserves the right to charge the traveler an additional planning fee.

Indemnification: The traveler shall indemnify, defend and hold harmless Maritz Journeys, its parent company, affiliates, subsidiaries and each of their employees, officers, directors, agents, successors and assigns from and against any and all losses, damages, claims, fines, penalties and expenses (including reasonable attorneys’ fees) that arise out of or result from: (i) injuries or death to persons or damage to property in any way resulting from or arising out of any acts or omissions of the traveler or agent or any other persons participating in the travel arrangements at the traveler’s request; (ii) any failure of the traveler to perform, or to cause the performance of, its obligations under this Agreement; or (iii) any acts or omissions of the traveler or agent or any other persons participating in the travel arrangements at the traveler’s request in violation of any applicable law or regulation.

Limitations of Liability: To the greatest extent permissible by applicable law, and except for indemnified matters and the collection of Maritz Journeys’ fees and expenses (including reasonable attorneys’ fees and expenses), (i) both Maritz Journeys and the traveler’s right to recover damages is limited to, in the aggregate, the amount received by Maritz Journeys from the traveler within the Itinerary/Invoice; and (ii) neither Maritz Journeys nor the traveler shall have liability to the other, or any other person or entity, for any indirect, incidental, special, consequential or punitive damages, whatsoever, including without limitation loss of data or programming, loss of revenue or profits, lost or damaged data, failure to realize savings or other benefits or other commercial or economic loss, even if such damages are foreseeable or if Maritz Journeys or the traveler have been advised of the possibility of such damages.

Alumni Travel Concierge is a travel service administrator and internet web site only and does not control, produce, sell or operate any of the travel products or services that are sold through Maritz Journeys. As such, Alumni Travel Concierge and it’s owner Charter Consultants LLC is not responsible for any claims based on the conduct of Maritz Journeys, its officers, directors, principles, employees, agents or independent travel suppliers that will be providing their services as part of the travel program.  Accordingly, Alumni Travel Concierge and it’s owner, Charter Consultants LLC is not responsible for any loss or injury which may be caused or contributed to by the travel operator, independent travel suppliers, any entity engaged in conveying participants or by any other cause, condition or event whatsoever beyond the direct control of Alumni Travel Concierge and it’s owner, Charter Consultants LLC.  Alumni Travel Concierge and it’s owner Charter Consultants LLC is not responsible for any and all liability for claims resulting from any acts or omissions of the travel operator and independent travel suppliers providing accommodations, transportation and travel services in connection with the travel arrangements, or from any other cause, condition or event beyond the direct control of Alumni Travel Concierge and it’s owner Charter Consultants LLC.

The Association is not the Tour Operator. The Association acts only as agent for the participants with respect to travel services, and it shall not be responsible for changes of flight times, fare changes, dishonor of airline, hotel or other reservations, injury, damage, loss of baggage, accidents or for the acts or defaults of any person or entity engaged in conveying participants or in carrying out other arrangements of the tour. Further, the Association shall not be responsible for losses or additional expenses of the participant due to sickness, weather, strike, civil unrest, acts of terrorism, quarantine, acts of God, or other causes beyond its control.

The Association shall not be responsible for alteration in an itinerary as deemed necessary for carrying out the travel service(s) purchased and the right is reserved to substitute hotels of similar quality. The right is further reserved to cancel any tour or travel-related component prior to departure; in which case the entire payment may be refunded without further obligation on its part. No refund will be made for the unused portion of any tour.

Participants on any Alumni Travel Concierge  pre/post group tours or independent tours and/or those who purchase itemized travel-related services components (air arrangements, hotel/ship/river vessel/train accommodations, sightseeing, and tour packages) accept in full all of the conditions set forth above.
